Meeting Minutes

7:00PM General Board business was discussed.
The Minutes for 12-23-14 were read and accepted.
Rick Lunden, attending as an observer is interested in becoming a Board member.
Fred noted that we have to change the meeting starting time from 7:30PM to 7:00PM
on the Town website.
Ron recommended the ZBA minutes only be sent to the Town website, and included in the ZBA file instead of making copies for the Building Inspector, Town Clerk, Executive Secretary, and HCC. ZBA minutes can be viewed online.

Roger Woods, surveyor, attended the meeting and assisted Brian in explaining the history of the lot(s) in question. Roger explained that 8 lots were created in 1956/1957. Tax records show that lots 1 and 8 (12-A-04) were separate parcels in 1989. Lots 1 and 8 were joined in 1990 with 110’ of frontage, (lot 1), which is the same frontage as in 1957.
Brian Johnson bought property in 2001. Property included lots 1,8, and a portion of lot 7 which runs along the westerly side of lot 1 and continues in a straight line approximately 603’ to the end. Roger pointed out a notation on a deed commissioned by Walter and Edna Woods for lot 9, November 10, 1989 which reads...”remaining land of Walter and Edna Woods Bk 2587 Pg 493 (7.11 acres) to become an integral part of lot 1”. Also, on
the lot 9 deed is noted that “Approval under the subdivision control law not required”, signed by the Holland Planning Board on 12-11-89.
Roger gave copies of maps, tax records, deeds, and property transfers to Fred.
Due to the length of time taken so far on the application, Fred asked Brian if he would
agree to a time extension for his request. Brian went to the Town Clerk’s Office and completed the request for an extension for his applications 1560, and 1599.
While waiting for Brian to return, Peter Frei, 101 Maybrook Road, asked to speak on the case. Peter noted that there is a 5 year grace period to build for two parcels in common ownership. If an owner does not build within the 5 years after the lots were sold the property becomes non-conforming. It is his opinion that this property cannot be built upon. Peter referenced MGL CH48. Sec.6.
When Brian returned, the Board set a site visitation for Jan. 17, at 10AM.
A continuance was set for Jan. 27, at 7:30 PM.

Rick Lunden was asked to come forward and sit with the Board and discuss any questions he had concerning the way the Board operates and what his responsibilities
as a Board member might be. After discussing some questions, Rick indicated that he would like to become a member. The Board voted unanimously for Rick to join. Voting in favor of accepting Rick as a Board member were Fred Beaulieu, Don Beal, Ron Seaburg, and Tom Kenney.
